In the event of the loss of a close family member, workers in the Republic of North Macedonia have a legal right to compensation for work-related expenses. Here are the key details:
- Legal Basis: According to the Labor Relations Law (“Official Gazette of RM” No. 62/2005, including amendments), an employee is entitled to compensation for expenses in the event of the death of the employee or a member of their family.
- General Collective Agreement for the Private* Sector: As per the General Collective Agreement for the Private Sector in the field of economy (“Official Gazette of RM” No. 88/2009, 60/2010, 81/2012, 189/2013, 119/2015, 150/2016), in the case of the death of a spouse, child, or parent living in the same household, the employee is entitled to compensation equivalent to 2 base amounts. The base amount is calculated based on the average monthly net salary per employee in North Macedonia, paid in the last three months.
- *For employees in the public sector, similar provisions apply under the General Collective Agreement for the Public Sector.
- Procedure for Exercising the Right: a. The employee submits a written request to the employer, accompanied by the necessary documentation (e.g., death certificate, proof of kinship, etc.). b. The compensation is paid in the next payroll cycle after the request is approved. Additionally, the employee is entitled to up to 3 days of paid leave to organize the funeral, with salary compensation provided by the employer.
